These Terms of Service govern your access to and use of scalpertcg.com and any purchase made through the website.

The terms “SCALPER TCG”, “we”, “us” and “our” refer to the seller operating the store. Our store is powered by Shopify, which provides the ecommerce infrastructure used to deliver the Services.

By accessing the Services or placing an order, you agree to these Terms and the policies incorporated by reference. If you do not agree, you should not use the Services.

Nothing in these Terms restricts any mandatory consumer right available under applicable law.

1. Eligibility, Accounts and Customer Information

You must be at least 18 years old, or have the authorisation of a parent or legal guardian, to place an order.

If you purchase on behalf of a business, you confirm that you are authorised to bind that business.

You must provide accurate, current and complete account, billing, payment and delivery information.

You are responsible for protecting access to your customer account and for activity carried out through it. Contact us promptly if you suspect unauthorised access or misuse.

Accounts are personal and may not be sold, transferred or assigned without our permission.

2. Products and Collectible-Specific Information

We sell trading-card game products and related collectibles, including sealed products, single cards, graded cards, accessories and selected merchandise.

We aim to describe and photograph products accurately. Device displays, lighting, production differences and packaging variations may affect the appearance of colours and products.

For single cards and individually identified graded cards, product images will normally show the actual item unless the product page clearly states that representative images are being used.

Product descriptions, availability and specifications may be updated where reasonably necessary.

Sealed and Randomised Products

Booster packs, booster boxes, decks and similar products may contain randomised contents selected and packaged by the manufacturer.

Unless expressly stated on the product page, SCALPER TCG does not guarantee:

• Any specific card or product.

• Any particular rarity.

• Pull rates or guaranteed hits.

• Card centring or print quality.

• Investment value or future market price.

• A specific result from opening a sealed product.

Minor factory variations in wrapping, seals, centring, ink, packaging or print finish may occur. Any material damage known to us will be disclosed.

Mandatory rights concerning counterfeit, defective, damaged or misdescribed goods remain unaffected.

Single and Graded Cards

Condition descriptions for ungraded cards are assessments made in good faith using the condition stated on the product page or our published condition guide.

Grading companies are independent third parties. A grade or certification is their professional opinion and does not constitute a guarantee by SCALPER TCG of future value, liquidity or acceptance by another grading company.

Where provided, customers should check certification numbers through the relevant grading company’s official database.

SCALPER TCG remains responsible for delivering the item described and for all mandatory authenticity and conformity obligations.

Trademarks and Affiliations

Pokémon, One Piece, Dragon Ball, Yu-Gi-Oh!, Magic: The Gathering, Panini, Topps, Naruto and other product names, logos, characters and intellectual property belong to their respective owners.

Their appearance on the Services identifies genuine product categories and does not imply sponsorship, endorsement or affiliation with SCALPER TCG unless expressly stated.

3. Orders and Contract Formation

Placing an order constitutes an offer to purchase.

An automated acknowledgement confirms that we received the order but does not necessarily constitute acceptance.

A sales contract is formed when we send an order confirmation accepting the order or dispatch the goods, whichever occurs first.

Before acceptance, we may decline or cancel an order where reasonably necessary, including because of:

• Unavailable stock.

• An obvious pricing or product-information error.

• Failed or incomplete payment.

• Suspected fraud or unauthorised payment.

• Sanctions or legal restrictions.

• Breach of clearly disclosed quantity limits.

• A delivery destination we cannot serve.

If payment has already been captured for an order that we cannot accept, we will refund the affected amount through the original payment method.

Limited releases may be subject to quantity restrictions. We may cancel duplicate or coordinated orders that reasonably appear intended to evade a clearly disclosed restriction.

Product allocation is not guaranteed until the order is accepted.

Retail and legitimate business orders are permitted. Separate wholesale, resale or export terms may apply to business customers and will be presented or agreed before an order is accepted.

4. Preorders, Drops and Product Allocations

Products marked as preorders have an estimated release or dispatch date. This date may change because of decisions or delays involving manufacturers, licensors, distributors, customs authorities or carriers.

We will communicate material delays when reasonably possible.

Preorders and limited releases may be subject to supplier allocation. If we cannot fulfil all or part of an accepted preorder, we will offer an appropriate replacement where available or refund the affected amount.

Any specific preorder conditions will be displayed before purchase and cannot remove mandatory consumer rights.

A market-price increase or decrease after an order has been accepted does not allow either party to change the agreed price.

5. Prices, Taxes and Currency Conversion

The final product price and charges displayed during checkout and in the order summary apply to the order.

Prices may change before an order is placed. Unless expressly stated otherwise, price changes will not affect an accepted order.

Prices include applicable sales taxes where required by law or indicated by the storefront. Shipping charges, import duties and additional costs will be shown separately where applicable.

For deliveries outside a territory served on a tax-paid basis, the recipient may be responsible for import duties, local taxes, customs charges or carrier fees unless checkout expressly states “duties paid”, “DDP” or equivalent.

We do not control charges imposed directly by foreign authorities or carriers.

Prices displayed in a visitor’s local currency may be converted through Shopify or a payment provider. The final charged currency, exchange rate and any card-provider fee will be shown at checkout or determined by the customer’s payment provider.

6. Payment

Available payment methods are displayed during checkout.

You confirm that you are authorised to use the payment method selected and that the information supplied is accurate.

Payments may be processed by Shopify and independent payment providers under their own terms and privacy notices.

We may carry out lawful verification and fraud-prevention checks before accepting or dispatching an order.

7. Shipping, Fulfilment and Delivery

Available destinations, shipping rates and estimated delivery times are displayed during checkout.

Delivery dates are estimates unless we expressly confirm a guaranteed date. We are not responsible for delays caused by circumstances outside our reasonable control, but this does not remove remedies available under mandatory consumer law.

Some products may be dispatched directly by an approved supplier or fulfilment partner. An order may therefore arrive in more than one parcel.

Unless a product page clearly identifies an independent marketplace seller, SCALPER TCG remains the seller and the customer’s point of contact.

For consumer orders, risk of loss or damage passes to the customer when the customer, or a third party nominated by the customer other than the carrier, takes physical possession of the goods.

If a customer independently appoints a carrier that was not offered by us, risk may pass when the goods are delivered to that carrier, where permitted by applicable law.

Customers must provide a complete and deliverable address and cooperate with reasonable carrier or customs requests.

Additional costs caused by an incorrect address, unjustified refusal of delivery or repeated failed delivery attempts may be charged where legally permitted and properly evidenced.

8. Cancellations, Returns and Refunds

Return periods, withdrawal rights, exclusions, procedures and refund times are described in our Refund Policy.

Where a statutory withdrawal right applies, customers may inspect goods only to the extent reasonably necessary to establish their nature, characteristics and functioning.

Opening factory-sealed booster packs, booster boxes or randomised products may go beyond the handling reasonably possible in a physical store. Where permitted by law, the customer may be responsible for the resulting reduction in value.

Nothing in these Terms restricts rights relating to counterfeit, defective, damaged or misdescribed goods.

Applicable conformity rights and legal guarantees always remain available.

9. Authenticity and Responsible Collecting

We source products from suppliers assessed in good faith and do not knowingly sell counterfeit products.

If you reasonably believe that an item is counterfeit, contact support@scalpertcg.com with your order number, photographs and any relevant evidence so that we can investigate.

If the item is confirmed to be counterfeit or materially misrepresented, we will provide the remedy required by applicable law.

Collectibles are not financial products.

Historical prices, rarity descriptions, grading results and market commentary are provided for informational purposes only. We do not promise appreciation, resale profit, liquidity or any specific investment result.

10. SCALPER CLUB and Restricted Services

SCALPER CLUB may provide invite-only access, early access, private releases, membership benefits or other restricted services.

Additional conditions may be presented before a membership or restricted service is activated or purchased.

Access is personal and cannot be transferred unless expressly permitted.

We may suspend access for fraud, misuse, abusive conduct, chargeback manipulation or attempts to bypass fair-release controls.

Cancellation and refund rights for a paid membership will be governed by the specific membership conditions and mandatory consumer law.

11. Intellectual Property

The SCALPER TCG name, original logo, website design, text, graphics, photographs and other original materials are owned by us or used under licence and are protected by applicable intellectual-property laws.

You may use the website for personal shopping and legitimate business purchasing.

Unless applicable law permits otherwise, you may not reproduce, redistribute, scrape, republish, modify or commercially exploit our original content without prior permission.

Third-party product names, logos, artwork, characters and other intellectual property remain the property of their respective owners.

12. Reviews, Submissions and Feedback

You must have the necessary rights to submit reviews, photographs, feedback or other content.

Submitted content must be truthful and must not be unlawful, defamatory, misleading, abusive, infringing or contain personal information that you are not authorised to disclose.

You retain ownership of content you submit.

By submitting content, you grant SCALPER TCG a non-exclusive, worldwide and royalty-free licence to host, reproduce, display and use that content for operating, improving and promoting the Services.

We may moderate or remove content where reasonably necessary to comply with law, protect users or enforce these Terms.

We are not required to publish or retain submitted content.

13. Acceptable Use and Release Integrity

You may not use the Services to:

• Break applicable law.

• Commit fraud.

• Infringe intellectual-property or privacy rights.

• Introduce malicious code.

• Interfere with website security or operation.

• Harvest personal information.

• Impersonate another person or organisation.

• Send spam or misleading communications.

• Disrupt another customer’s use of the Services.

• Circumvent quantity limits, queues or release controls.

Bots, scripts, autonomous agents or other automated systems may not be used to bypass CAPTCHAs, purchasing limits, queues, access restrictions or release rules.

We may block related activity and cancel affected orders in accordance with Section 3.

14. Third-Party Services and Shopify

Our store is hosted by Shopify, which provides the ecommerce infrastructure used to deliver the Services.

Purchases made through this store are made directly from SCALPER TCG and not from Shopify.

Shopify and other providers may process personal information or payments as described in our Privacy Policy and their respective notices.

Third-party links, applications or tools may be provided for convenience and are governed by the third party’s own conditions.

We are not responsible for third-party content or transactions completed outside our store, except where applicable law provides otherwise.

15. Privacy and Cookies

Our processing of personal information is described in our Privacy Policy.

Shopify’s processing of customer and visitor information is described in the Shopify Consumer Privacy Policy.

16. Errors, Availability and Website Operation

We may correct typographical mistakes, technical errors, inaccurate availability information or manifest pricing errors.

Where an error affects an order, we will contact the customer and apply the remedies described in Section 3 and required by applicable law.

We do not guarantee uninterrupted website availability.

We may maintain, secure, update or temporarily restrict access to the Services where reasonably necessary.

17. Disclaimer and Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud, wilful misconduct, death or personal injury caused by negligence, or mandatory consumer rights.

To the maximum extent permitted by law, we are not liable for indirect or unforeseeable losses that were not reasonably foreseeable when the contract was formed.

We are not responsible for business losses suffered by a customer purchasing as a consumer.

Additional limitations agreed in separate written business-to-business terms may apply to business customers.

We do not guarantee that use of the website will always be uninterrupted, secure or error-free, but this does not restrict any mandatory right or liability that cannot legally be excluded.

18. Events Outside Reasonable Control

Neither party is responsible for a failure or delay caused by an event outside its reasonable control, including natural disasters, war, civil disruption, government action, transport interruption, cyberattack, labour disruption or major supplier failure.

We will take reasonable steps to reduce the impact and resume performance.

Consumer cancellation, refund and delivery rights applicable under mandatory law remain unaffected.

19. Suspension and Termination

You may stop using the Services at any time.

We may suspend or terminate access where reasonably necessary because of unlawful activity, fraud, a security risk or material breach of these Terms.

Termination does not affect accepted orders, accrued payment obligations, existing claims or provisions intended to remain effective after termination.

20. Governing Law and Disputes

These Terms and contracts made through the Services are governed by the laws of Spain.

This choice of law does not deprive a consumer of mandatory protections provided by the law of their country of habitual residence.

Where mandatory consumer-jurisdiction rules do not provide otherwise, the courts of Las Palmas de Gran Canaria, Spain, will have jurisdiction.

Consumers may also bring proceedings before any court competent under applicable mandatory law.

21. General Provisions

If any provision is found to be unlawful or unenforceable, it will be limited or removed only to the minimum extent necessary. The remaining provisions will continue in effect.

A failure to enforce a provision does not constitute a waiver.

Customers may not transfer their accounts or contractual rights except where applicable law permits.

We may transfer our rights and obligations as part of a lawful restructuring, merger or sale, provided that this does not reduce mandatory customer rights.

These Terms, the order confirmation and the policies expressly incorporated by reference constitute the agreement between the customer and SCALPER TCG for the Services.

If there is a conflict, mandatory law prevails, followed by any specific conditions disclosed for the relevant product or service, the order confirmation, these Terms and the incorporated policies.

22. Changes to These Terms

The version displayed when an order is placed applies to that order.

We may update these Terms for future use of the Services.

Material changes will be communicated where required by law and will not retroactively reduce rights arising from an existing contract.
